You understand that progress in language learning varies by individual and that outcomes depend on many factors, including attendance, effort, practice, and prior experience. We do not guarantee specific results, fluency, proficiency levels, certification outcomes, or business/academic success.
4. Payment Terms and Conditions
All fees, package prices, subscription charges, and other applicable costs will be disclosed to you prior to purchase or registration, unless otherwise stated in writing by us.
- Payment is due in full at the time specified by us, which may be at booking, before the first class, in advance of a package, or on a recurring basis for subscription-style offerings.
- We may accept payment by credit card, debit card, electronic transfer, or other methods we designate from time to time.
- Unless expressly stated otherwise, all fees are listed and payable in Canadian dollars (CAD).
- You are responsible for all applicable taxes, including GST, PST, HST, or other taxes required by law.
- If a payment is declined, reversed, disputed, charged back, or otherwise not successfully processed, we may suspend or terminate access to services until the outstanding amount is paid in full.
- Where applicable, late or missed payments may result in administrative fees, loss of reserved class space, cancellation of lessons, or removal from a course or program, subject to applicable law.
We may change our pricing at any time for future purchases or renewals. Price changes will not affect services already paid for, unless otherwise agreed in writing or required by law.
5. Cancellation and Refund Policy
Our cancellation and refund policy is intended to balance fairness, operational scheduling, and the limited availability of teaching resources.
- Private lessons: Cancellations or rescheduling requests must be made within the timeframe communicated at booking or, if no timeframe is stated, at least 24 hours before the scheduled session. Missed sessions or late cancellations may be charged in full.
- Group classes: Withdrawals from group classes after the start date may not be refundable, except where required by law or expressly agreed in writing by us.
- Packages and bundles: Unless otherwise stated, unused sessions in a discounted package may be subject to prorated refund calculations, less any completed sessions at the standard per-session rate and any non-refundable administrative charges, where permitted by law.
- Online services: Technical issues on your side, including internet connectivity, incompatible devices, or user error, do not automatically entitle you to a refund. We may, at our discretion, offer a make-up session or alternative accommodation.
- Company cancellations: If we cancel a paid session and cannot reasonably reschedule it, we will generally offer a refund or credit for the affected session, unless another remedy is required or permitted by law.
- Refund timing: Approved refunds may take a reasonable period to process through the original payment method.
To request a cancellation, rescheduling, or refund, you must contact us using the contact details below. Any refund decision may require review of attendance records, communications, and payment history. Nothing in these Terms limits any non-waivable rights you may have under applicable Canadian consumer protection law.
6. Liability Limitations
To the fullest extent permitted by applicable law, Lusophone Language Learning Ltd. and its directors, officers, employees, instructors, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of data, loss of business, loss of goodwill, or interruption of business arising out of or related to your use of the services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount you paid to us for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to the claim, or CAD $100, whichever is greater, unless a greater liability cannot be excluded under applicable law.
We do not guarantee uninterrupted, secure, or error-free access to online services, third-party platforms, or communications. We are not responsible for delays, failures, or damages caused by internet outages, platform disruptions, device compatibility issues, third-party services, acts of omission by third parties, or circumstances beyond our reasonable control.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or any other liability that cannot lawfully be excluded in Canada.
